Some argue that the Criminal Justice System of Australia should introduce the harm minimisation technique that was introduced into to Amsterdam. This strategy was to decriminalise marijuana. This was used to stop the use of ‘hard drugs’ such as heroin. The programme was quite successful. This is a rather extreme technique but it was proved effective. It was a new strategy that had not been used before by any other county and the results of the programme became apparent relatively fast. Australia could introduce this programme into the Criminal Justice System as it is quite efficient in that the results are quite quick. However for this programme to be even considered in the distant future, the Criminal Justice System needs to start educating the younger generations through schooling and remove the image that drugs such as marijuana are not so bad in comparison to other drugs such as cocaine and heroin. Though in doing so, one could argue that children would be more inclined to try heroin and the gateway theory of drugs could be applied meaning that marijuana could be a gate way into more hard drugs thus resulting in the programme being ineffective and a waste of time and resources.
Another expectation that the public has on the Criminal Justice System is being timely and cost effective in the resolution of disputes. It seems that if the public have any legal problem whether it is a civil or criminal matter. The Criminal Justice System tries to try and meet the public’s expectation to have a timely resolution of a dispute by assisting in getting legislation passed to help the courts be more time effective. One of these strategies is having indictable offences heard summarily. This means that any indictable offence that does not exceed the jurisdiction of the Magistrates’ Court, the offender can apply to have their case heard summarily. This helps to make the courts more efficient as a case heard summarily is usually resolved in ... where as a normal indictable offence would be solved in around .... years. Though many people argue that cases heard summarily are a lesser form of justice, and essentially not fair to the omission against society the accused may have committed, as any form of time that is not spent on a case is in favour of the accused as they are innocent until proven guilty.
The Criminal Justice System tries to solve the public’s expectation to a cost effective resolution. It tries to do this by offering Victoria Legal Aid. Victoria Legal Aid is a service that is provided to lower class individuals that have been introduced into the courts system but do not have enough money to pursue their case. One major limitation of Victoria Legal Aid is that a middle class citizen will usually not be accepted into the programme as they are just over the threshold of the earning income for the Victoria Legal Aid service to be offered. The average wage is not enough to cover legal fees for a barrister that can be in excess of ..... dollars. This can make the Victorian Legal Aid service unfair.
